Between deciding whether affirmative action in college admissions is unconstitutional and whether to adopt the independent state legislature theory, the upcoming U.S. Supreme Court term rivals (almost) any recent term and the docket is only about half full! Also of interest to states and local governments, the Court will try again to define wetlands per “waters of the United States,” and will decide a significant Spending Clause case.
