Between deciding whether affirmative action in college admissions is unconstitutional and whether to adopt the independent state legislature theory, the upcoming U.S. Supreme Court term rivals (almost) any recent term and the docket is only about half full! Also of interest to states and local governments, the Court will try again to define wetlands per “waters of the United States,” and will decide a significant Spending Clause case. Join Timothy Bishop, Mayer Brown, who will argue a dormant commerce clause case, Eric Olson, Colorado Solicitor General, who will argue a case about a free speech challenge to state law, and Ian Gershengorn, Jenner & Block, who will argue a case considering the constitutionality of parts of the Indian Child Welfare Act, in a discussion of the most important cases for states and local governments currently on the Supreme Court’s docket.
